SMS Messaging Terms & Consent

These SMS Terms describe how DESI, operated by Desi Drivers LLC ("we", "us", "our"), sends and receives text messages ("SMS") from users of the DESI mobile application, the desidrivers.com website, and DESI printed marketing materials (coasters, stickers, posters). By providing your mobile phone number to DESI in any of the channels described below, you agree to these SMS Terms.

1. Program Description

DESI operates a Designated Driver marketplace: users hire a vetted, background-checked driver to drive them home in the user's own vehicle. Our SMS program supports the following transactional and marketing message types:

• Account verification codes (2FA): one-time codes to verify your phone number when you sign up or log in.
• Trip status alerts: your driver is on the way, your driver has arrived, your ride is complete, etc.
• Safety and dispatch notifications: when a driver-pair has been assigned, when a recovery driver is inbound, and safety-critical incident alerts.
• Bar & venue partner app-download links: when you scan a DESI coaster at a partner bar and request the app link via SMS.
• Waitlist & event confirmations: when you sign up for launch waitlist notifications or RSVP for a DESI event.
• Promotional messages: occasional messages about referral credits, promo codes, and launch announcements. Never more than a few per month.

2. How You Consent (Opt-In)

You provide express written consent to receive SMS from DESI when you take any of the following actions:

• Enter your phone number on the desidrivers.com waitlist form and click "Get Notified."
• Enter your phone number in the DESI mobile app during account creation, and tap the checkbox agreeing to receive SMS.
• Enter your phone number on a bar-partner coaster landing page (e.g. desidrivers.com/bar/<bar-name>) and tap "Text me the app link."
• RSVP for a DESI event via a form that discloses SMS confirmation.

At each of these points, the collection form explicitly states that submitting your phone number opts you in to DESI SMS, links to these SMS Terms, and links to our Privacy Policy.

3. Message Frequency

Message frequency varies by user activity. Typical volumes:

• Trip-related: 3-6 messages per trip (dispatch, arrival, in-progress, completion).
• Account verification: 1 message per sign-in or sensitive action.
• Bar partner app-link: 1 message per scan event, initiated by you.
• Waitlist: 1 confirmation on signup + at most 2 launch-related messages over the following 6 months.
• Promotional: Not more than 4 per month.

4. Costs

Message and data rates may apply. DESI does not charge you for messages, but your mobile carrier may charge you standard SMS/MMS rates or count messages against your plan's allowance. Contact your carrier for details of your specific plan.

5. How to Opt Out (STOP)

You can opt out of DESI SMS at any time and at no cost by replying with any of the following keywords to any DESI message:

STOP   END   CANCEL   UNSUBSCRIBE   QUIT

Upon receipt of your opt-out request, DESI will send you one final confirmation SMS acknowledging that you have unsubscribed, and you will receive no further messages from the DESI SMS program. This does not affect your DESI mobile app account — you can continue to use the app.

If you have opted out and later wish to re-enroll, reply START to any prior DESI message or re-enter your phone number in the app or on desidrivers.com.

7. Supported Carriers

DESI SMS supports all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon Wireless, Sprint, U.S. Cellular, Boost Mobile, MetroPCS, Cricket Wireless, Virgin Mobile, and most regional and MVNO carriers. Carriers are not liable for delayed or undelivered messages.

8. Privacy

Your phone number and message activity are treated as personal information under our Privacy Policy. We do not sell your phone number to third parties. We do share your number with our SMS delivery vendor (Twilio Inc.) solely for the purpose of delivering the messages you have requested.

9. Changes to These Terms

We may update these SMS Terms from time to time. The "Last updated" date at the top reflects the most recent version. Material changes will be communicated via SMS or in-app notification at least 30 days before taking effect.
