Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the DESI mobile application or the desidrivers.com website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. DESI is operated by Desi Drivers LLC, a California limited liability company ("Company," "we," "us," or "our").

2. Description of Service

DESI is a designated driver platform that connects individuals who need a driver ("Riders") with independent contractor drivers ("Drivers") who drive the Rider home in the Rider's own vehicle.

DESI is not a transportation company. We provide a technology platform that facilitates connections between Riders and Drivers. Drivers are independent contractors, not employees of Desi Drivers LLC.

3. Eligibility

• You must be at least 21 years of age with a valid phone number and email address.
• Riders must be the legal owner or authorized user of the vehicle, with valid registration and insurance.
• Drivers must hold a valid driver's license (3+ years), pass a background check and motor vehicle record review, maintain a clean driving record, complete DESI onboarding, and comply with all recording and safety equipment requirements.

4. Accounts

You agree to provide accurate information, keep credentials secure, and accept responsibility for activity under your account. We may suspend or terminate accounts for violations of these Terms, fraud, safety concerns, or non-payment.

• Fares are shown before you confirm a ride and processed through our payment processor (Stripe / Apple Pay).
• By requesting a ride you authorize the charge for the quoted fare plus any applicable fees, tips, or adjustments.
• Cancellation fees may apply after a Driver has been dispatched.

7. Rider Responsibilities

• Confirm you are legally authorized to allow the Driver to operate your vehicle and that it is registered, insured, and safe to drive.
• Treat Drivers with respect. Abusive, threatening, or unlawful behavior results in removal from the platform.
• Accurately report vehicle condition through the pre-trip drivability attestation.

8. Driver Responsibilities

• Operate the Rider's vehicle safely and lawfully at all times.
• Maintain active personal auto insurance for your own vehicle, including your commute to and from jobs.
• Complete pre-trip vehicle inspection photos and comply with the dashcam evidence-chain protocol on every trip.

9. SMS Communications

The Service uses text messages for verification codes, trip alerts, and opt-in promotions. Message frequency varies; message and data rates may apply; reply STOP to opt out or HELP for help. See our SMS Messaging Terms & Consent for the full program description. Mobile numbers and SMS consent data are never shared with third parties for marketing.

10. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Desi Drivers LLC's total liability for any claim arising from the Service will not exceed the greater of the amount you paid us in the twelve months preceding the claim or $100. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Dispute Resolution

These Terms are governed by the laws of the State of California. Any dispute will be resolved in the state or federal courts located in Sacramento County, California, unless the parties agree to binding arbitration.

12. Changes to These Terms

We may modify these Terms from time to time. Material changes will be announced in the app or by email. Continued use of the Service after changes constitutes acceptance.
